Terms of Use

These Terms of Use ("Terms") are an agreement between you and A&S LLC ("A&S LLC," "we," "us," or "our") covering your use of Property Deal Scope, Fairway Tap, their web versions, and this website (together, the "Services"). By downloading or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. ELIGIBILITY You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the permission of a parent or guardian.

2. LICENSE We grant you a personal, non-exclusive, non-transferable, revocable license to use the Services on devices you own or control, for your personal, non-commercial use, subject to these Terms and the rules of the app store you downloaded from.

3. ACCEPTABLE USE You agree not to:

• copy, modify, distribute, sell, or lease any part of the Services;

• reverse engineer or try to extract the source code, except where the law allows it;

• use the Services for anything unlawful, or in a way that could harm the Services or other people;

• interfere with the ads, purchases, or security features of the Services.

4. PURCHASES AND SUBSCRIPTIONS Some features may require an in-app purchase or subscription. Purchases are processed by Google Play or the Apple App Store and are subject to their terms. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Google Play or App Store account settings. Refunds are handled by Google Play or Apple under their refund policies. Prices and features may change.

5. ADS The free version of the Services may show ads provided by Google AdMob. We are not responsible for third-party ads or the websites they link to.

6. NOT PROFESSIONAL ADVICE Property Deal Scope gives estimates based on the numbers you enter. It is not financial, investment, tax, or legal advice. Check your numbers and talk to a qualified professional before making any investment decision.

7. SAFETY (FAIRWAY TAP) Distances, shot estimates, and GPS readings in Fairway Tap are estimates and may be inaccurate. Stay aware of your surroundings on the golf course, follow course rules, and do not use the App while driving a cart or in any unsafe situation.

8. YOUR DATA Data you enter is stored on your device. You are responsible for it, including backing it up. Uninstalling the App deletes it. See our Privacy Policy for how information is handled.

9. THIRD-PARTY SERVICES The Services use third-party services such as RevenueCat, Google AdMob, and OpenStreetMap. Your use of them may be subject to their own terms. OpenStreetMap map data is © OpenStreetMap contributors and is available under the Open Database License.

10. INTELLECTUAL PROPERTY The Services, including their software, design, names, and logos, are owned by A&S LLC or its licensors and are protected by law. These Terms do not give you any ownership rights.

11. DISCLAIMER OF WARRANTIES THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

12. LIMITATION OF LIABILITY TO THE FULLEST EXTENT ALLOWED BY LAW, A&S LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR INVESTMENTS, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. Some places do not allow these limits, so they may not apply to you.

13. INDEMNITY You agree to hold A&S LLC harmless from claims arising from your misuse of the Services or your violation of these Terms.

14. TERMINATION We may suspend or end your access to the Services if you violate these Terms. You may stop using the Services at any time by uninstalling the Apps.

15. CHANGES We may update these Terms from time to time. We will post the new version on this page and change the effective date. Continuing to use the Services after a change means you accept the updated Terms.

16. GOVERNING LAW These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules.

17. APPLE APP STORE USERS If you downloaded an App from the Apple App Store, these Terms are between you and A&S LLC, not Apple. Apple is not responsible for the App or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
